Recruitment
Artificial intelligence used in employment, recruitment, and workforce management falls directly under Annex III, Section 4 of the European Union AI Act. Any AI system that filters job applicants, evaluates candidate assessments, assigns tasks, or monitors employee performance is legally designated as High-Risk.
Scope of Employment AI Under Annex III
The classification applies broadly to software used across every stage of the talent lifecycle:
- Candidate Sourcing and Screening: Algorithms analyzing CVs, scoring candidates, or ranking applicants for recruitment.
- Interview and Assessment Analytics: Tools evaluating cognitive ability, video interviews, or behavioral metrics.
- Workforce Allocation and Task Assignment: Automated scheduling or task distribution models determining compensation or promotion opportunities.
- Termination and Performance Monitoring: Automated evaluation tools that recommend dismissal, reprimand, or performance improvement tracking.
Mandatory Compliance Requirements for HR Tech Deployers
Organizations deploying third-party or proprietary recruitment tools must establish rigorous internal oversight:
- Bias Mitigation and Dataset Scrutiny: Datasets used to train or evaluate candidate models must be checked for historical bias, demographic skew, and discrimination risks against protected classes under EU law.
- Human Oversight and Override Authority: HR personnel overseeing AI-driven selection must have the technical authority, training, and operational capability to reject, override, or modify any algorithmic hiring recommendation without friction.
- Continuous Logging and Traceability: The system must record detailed telemetry for every candidate decision, including feature weighting, retrieval scores, and timestamped outcome trails for at least six months.
- Mandatory Candidate Transparency: Candidates must be informed when an AI system is being utilized to assess or filter their application, with clear instructions on how to request human review.
Implementation Checklist for HR and Talent Operations
To avoid non-compliance fines reaching up to €35 million or 7% of worldwide turnover, talent acquisition leaders must conduct immediate audits of all recruitment platforms. Organizations must inventory internal tools, request conformity declarations from HR software vendors, and establish documented operational controls for every high-risk talent workflow.
